Deposed Sokoto district heads remain deposed, says Sokoto Commissioner for Justice

From Desmond Mgboh, Kano

Sokoto State Commissioner for Justice, Nasiru Binji, Friday insisted that the restraining order barring the deposition of the 10 district heads by the state government has elapsed.

Speaking to journalists in Kano State, Binji held that the applicants stand deposed adding that the court order ceased to exist seven days after it was granted.

He citrd Order 13 Rule 3 (3) of the High Court of Sokoto State Civil Procedure Rules 2015 to back his claim.

According to him, “By the operation of Order 13 Rule 3 (3) of the High Court of Sokoto State Civil Procedure Rules 2015 the Order has abated (vacated) automatically. Because the Order was made exparte.

“The duration of the order is seven days. The order was given by the court on 13 of June 2024, therefore, it vacated on the 20th June,” he argued.

It could be recalled that Justice Kabiru Ahmed of the Sokoto High Court had on June 13 ordered parties to maintain status quo in the case pending the determination of the substantive motion for interlocutory injunction filed before the same court.
